In the Spanish Penal Code , the crime of gender-based violence is clearly defined. According to Article 153.2, conduct that causes psychological harm, minor injuries, or mistreatment without injury to a woman who is or has been the wife of the aggressor, or who has had an emotional relationship with him, is punishable by imprisonment for 6 months to 1 year or by community service for 31 to 80 days.
On the other hand, Article 173.2 establishes prison sentences of 6 months to 3 years when physical or psychological violence is exercised habitually. Furthermore, aggravating circumstances are imposed if the crime occurs in the presence of minors, if weapons are used, or if it is committed in the shared residence or the victim’s residence.
