EXTORTION
The crime of extortion is punished through Article 243 of the Criminal Code, whose typical conduct consists of forcing another, with violence or intimidation, to perform or omit an act or legal business to the detriment of his assets or those of a third party, acting for profit. The perpetrator of this crime is punished with imprisonment from 1 to 5 years, without prejudice to the penalty corresponding to the acts of physical violence carried out.
This crime is committed, for example, by a husband who threatens his wife with a weapon during the separation proceedings to force her to sign certain documents for the relinquishment of property (STS No. 1024/2003) or by a person who forces the owner of an apartment to sign a contract for the indefinite extension of the use of the apartment (STS No. 20/2022).
