Breach of custodial duties

Child abandonment or abandonment of persons with disabilities is a particularly serious crime that occurs when a person in charge of their care or protection knowingly fails to fulfill their obligations, leaving them in a situation of helplessness or risk.

The crime of child abduction is regulated in Article 225 bis of the Penal Code, which punishes, with a prison sentence of 2 to 4 years and special disqualification from exercising parental rights for a period of 4 to 10 years, the parent who, without just cause, abducts their minor child.

The crime of family abandonment occurs when a person seriously fails to meet their legal obligations of assistance to their family members, especially in relation to financial support or the care of dependent persons.
