DELIVERY TO THIRD PARTIES OF MINORS OR PERSONS WITH DISABILITIES

Art. 231 typifies the crime of improper abandonment, which punishes the subject who, being in charge of the upbringing or education of a minor or a person with disabilities, hands him/her over to a third party or to a public establishment without the consent of the person who entrusted him/her, or of the authority. The penalty associated with this crime is a fine of 6 to 12 months, but if the life, health, physical integrity or sexual freedom of the minor or disabled person in need of special protection has been specifically endangered, the penalty is imprisonment of 6 months to 2 years.
